Conducting Thorough Workplace Investigations

This program will provide in-depth guidance on conducting workplace investigations. We will discuss how to determine when an investigation is required, who should conduct the investigation, and best practices to protect attorney-client privilege and work product defenses should there be further action after the investigation. The program will also include a skills-based discussion of investigative protocols and techniques by reviewing the eight recommended steps to conduct a thorough investigation.

Emily S. Borna is a Shareholder in the Atlanta, Georgia office of Jackson Lewis P.C.  She is also a member of the Firm’s Disability, Leave and Health Management Practice Group, which assists employers in meeting the legal and practical challenges posed by federal and state laws protecting injured and ill employees. Since completing law school, she has specialized in labor and employment litigation on behalf of management. She specializes in litigating employment law cases in federal and state courts and labor and employment agencies. Ms. Borna has experience advising businesses on compliance with federal, state, and local employment laws. She has drafted and reviewed employment policies and counseled corporate clients on sensitive disciplinary issues. Ms. Borna earned her law degree in 1994 at The University of Georgia School of Law, where she was a research and special projects editor of the Georgia Journal of International and Comparative Law. She also conducted her undergraduate studies at the University of Georgia and in 1991 received her B.A. degree, magna cum laude, with a major in political science. 


Alison E. Loy is an Associate in the Atlanta, Georgia office of Jackson Lewis P.C. Ms. Loy represents management in employment and labor matters in state and federal court and before various government agencies. Ms. Loy has defended employers against claims brought pursuant to Title VII, the Americans With Disabilities Act, the Family and Medical Leave Act, and state law. Ms. Loy has litigation experience in employment, general commercial disputes, shareholder and investor class actions, and real estate matters. Ms. Loy earned her J.D. from Emory University School of Law B.A. in 2007, with honors, where she was a Senior Editor for the Emory International Law Review. Ms. Loy received her B.A., from the University of Michigan, with distinction, with a major in English.
